KPMG LINK Business Traveller End User License Agreement
The KPMG LINK Business Traveller Website ("Site") is a software application through which expatriate and business traveller services ("Services") are offered by KPMG LLP of 15 Canada Square, London E14 5GL ("KPMG"). We also provide Services through the KPMG LINK Anywhere application, which may be available on Your mobile device (“Mobile Application”). Your use of the Site and the Mobile Application is voluntary but automatically binds you to their respective terms and conditions. The Terms of Use applicable to the Site are set out below and, in the case of the Mobile Application, you are required to accept the click through Terms of Use when You launch the application.
Services
The services we provide through the Site include assistance with tax, social security, immigration and other expatriate and business traveller issues (“Services”). We provide the Services in accordance with the engagement agreement with Your employer (“Engagement Agreement”).
Access and Termination
Access to the Site is restricted to authorized users only. You agree not to provide Your password, nor provide access to the Site, to any other person. You must promptly notify KPMG in the event that You become aware of misuse of Your password or unauthorized access or any other event or action that may impair Site security.
KPMG will deactivate Your access to the Site upon completion of the Engagement Agreement. Access to the Site may be suspended, limited, denied, or disabled at any time, including for reasons out of KPMG’s control, and the content contained in the Site may not be recoverable. On termination of Your access to the Site for any reason, all rights granted to You under these Terms of Use shall automatically cease.
Content
You are exclusively responsible for all content that you post on the Site including that all such content complies with all applicable laws and regulations and that the content will not infringe the intellectual property or data privacy rights of any third party.
The Site is not intended for use as a document retention system and should not be regarded as systems of record. You should download from the Site any content or data that You wish to retain for your own records.
Disclaimer and Warranties
The Site is accessible through a Web browser. You should use the latest supported version of a Web browser to access the Site. As with any Internet-based product, technical factors such as bandwidth, network configurations, network availability, GPS/GSM availability and laptop browser settings can affect the Site’s performance and accessibility. While KPMG uses commercially reasonable efforts to make the Site available on a 24/7 basis, the Site may be temporarily unavailable due to technology interruptions, for maintenance or other reasons. Accordingly, KPMG does not make any representation or warranty regarding the availability or accessibility of the Site.
KPMG does not guarantee that the Site will be free from all viruses and is not responsible for any damage caused by viruses or other malicious activities of third parties. You are advised to use appropriate anti-virus software.
Limitation of Liability
Your use of the Site has been arranged pursuant to the Engagement Agreement. KPMG’s entire liability, if any, relating to Your use of the Site and the Services is governed by the terms of such Engagement Agreement. Without limiting the foregoing, to the maximum extent permitted by applicable law, KPMG is not liable for any direct, indirect special, incidental or consequential damages, nor for damages for loss of business, loss of data, loss of profits or investments or the like
Third party software
The Site contains certain third party products, which are licensed to You by the owners or licensors of the products. Copyright acknowledgements and disclaimers apply to these products and are included in the Site. KPMG makes no representations or warranties regarding, and accepts no responsibility for, any third party products, including freedom from viruses or fitness of such third party products for any purpose.
Intellectual Property
KPMG reserves all of its proprietary rights relating to the Site and Services, including but not limited to copyright, trade secret, trade name, and trademark, and You acquire no right or interest in them. Any unauthorized use of any materials provided or accessed may violate copyright, trademark and other laws. Should You download materials for personal or non-commercial use, You must retain all copyright and other trademark notices contained in the original materials on any copies of the materials. Materials cannot be modified, reproduced, publicly displayed, performed or distributed or used for any public or commercial purposes.
Restrictions
You may not (i) license, sell or otherwise commercialize or exploit the Site, (ii) disassemble, reverse engineer or in any other way modify the Site or (iii) attempt to access other applications or areas of the Site or the infrastructure over which the Site is provided, to which You have not been granted permission.
You represent and warrant that You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that You are not listed on any U.S. Government list of prohibited or restricted parties.
Third Party Service Providers
KPMG may use administrative services operating at our direction, including third parties located inside and outside the United Kingdom, in connection with the Site and the Services. These third parties may be provided with access to Your information to perform administrative and clerical procedures.

These Terms and Conditions are governed by the laws of England and the exclusive jurisdiction of the English courts.
